Detailed Ruling on the Deadliest Attack in Turkey Lacks Key Components: Lawyers

A court in Turkey’s capital city Ankara declared on Thursday the detailed ruling for the aggravated life sentences it issued regarding the bombing of a rally that killed more than 100 people on 10 October 2015.

The bombing was the deadliest such attack in Turkey, and it targeted a peace rally of pro-Kurdish activists outside Ankara’s main train station.

The rally was held in Ankara during an election term calling for reopening of the negotiations that were terminated in July 2015, between the Turkish government and the outlawed Kurdistan Workers Party (PKK), a militant group that waged an armed insurgency in Turkey’s southeast for decades.

This period also corresponds with a string of suicide bombings in Turkey, which is a result of the deterioration of security along Turkey’s border with Syria, according to the law experts.

In August 2018 the court sentenced nine suspects to 101 consecutive life sentences each, on charges of murder, membership of a terrorist organization, and attempting to violate the constitution.

The reasoning of the court’s verdict, which consists of 872 pages lacked crucial elements that lead to the attack, according to a report by Gokcer Tahincioglu from the news portal T24.

Tahincioglu’s report criticizes the ruling for not underlining the key aspects such as the preparation of the explosives and lack of due diligence on the process.

In order to produce the bomb used in the attack, large amounts of ammonium nitrate were necessary, therefore the law enforcement officers’ lack of information on the acquiring and storing of this chemical by ISIS members would constitute criminal negligence, according to the report of T24.

The report further underlined the court’s abstention from calling the attack a crime against humanity.

According to the ruling of Ankara court, ISIS targets whomever it considers an obstacle to building a caliphate, in doing so does not specifically target a distinct ethnicity or religious group.

The ruling detailed the deeds of the militant group, with acts such as attacking military forces and policemen in Central Anatolian city of Nigde, abduction of 32 truck drivers, raiding of Turkey’s Mosul consulate and taking hostage of the 49 staff, and several bombings against HDP (The Peoples’ Democratic Party) rallies and headquarters.

Allegations on Government Complicity

Ahval News published excerpts from a confidential intelligence report in June 2018.

The intelligence report of the European Union Intelligence and Situation Centre, EUINTCEN, alleges that the Turkish government turned a blind eye against the attacks targeting HDP by consciously abstaining from taking due security measures.

“The modus operandi of the attack (suicide bombers) points to Da’esh [ISIS],” Ahval quoted the report and continued with its conclusion: “Given the circumstances (arriving buses with demonstrators not searched, police almost absent at the huge demonstration), there is reason to believe that, in this case, forces within the AKP commissioned the Da’esh operatives.”
